Terms of Service

1. Who we are
PermQueue (the "Service") is operated by Luis Henrique Menger Basqueira ("we", "us", "our"). By using the Service you enter into a binding agreement with Luis Henrique Menger Basqueira.
2. Acceptance of these terms
By creating an account, subscribing to alerts, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
3. The Service
PermQueue provides informational tools related to U.S. Department of Labor PERM data, U.S. Department of State Visa Bulletin data, and related immigration statistics, as well as optional paid email alerts. All information is provided for informational purposes only and is not legal advice. Always consult a qualified immigration attorney for your case.
4. Accounts
You must provide accurate information when creating an account and keep your credentials confidential. You are responsible for all activity under your account. You must be of legal age to form a binding contract.
5. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of any applicable law;
- commit fraud, send spam, or impersonate any person;
- infringe any intellectual property or privacy rights;
- introduce malware, probe, scan, or interfere with the security or integrity of the Service;
- scrape, crawl, or otherwise extract data from the Service in bulk or by automated means;
- reverse engineer, resell, or redistribute the Service or its content.
6. Intellectual property
The Service, including its software, design, branding, text, and original data products, is owned by Luis Henrique Menger Basqueira and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose and within the plan you have purchased. Underlying public-record source data (DOL OFLC, U.S. Visa Bulletin) is in the public domain.
7. Subscriptions, payments, and billing
Paid features (such as email alerts) are sold on a recurring monthly subscription. Our order process is conducted by our online reseller Paddle.com Market Limited ("Paddle"). Paddle is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. For payment, billing, tax, cancellation, and refund mechanics please refer to Paddle's Buyer Terms. Subscriptions renew automatically each month until cancelled. You can cancel at any time from the account page or via your Paddle customer portal; cancellations take effect at the end of the current billing period.
8. Service level
We work to keep the Service available, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. Source data may be delayed, missing, or inaccurate. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or exemplary damages, including loss of profits, data, goodwill, or business opportunity. Nothing in these Terms excludes liability for fraud, death, personal injury, or any liability that cannot be excluded by law.
10. Indemnity
You agree to indemnify and hold harmless Luis Henrique Menger Basqueira from any claims arising out of your use of the Service, your content, or your violation of these Terms.
11. Suspension and termination
We may suspend or terminate your access to the Service for: material breach of these Terms; non-payment; security or fraud risk; or repeated or serious policy violations. You may stop using the Service at any time. On termination, paid email alerts will stop at the end of your current billing period. We may delete account data after a reasonable retention period.
12. Changes to the Service or terms
We may modify the Service or these Terms at any time. Material changes will be communicated by updating the "last updated" date and, where appropriate, by email. Continued use of the Service after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Luis Henrique Menger Basqueira is established, without regard to conflict-of-law principles.
